September 21, 2021: Businessman Raj Kundra who had been arrested in July 2021 for allegedly creating and publishing pornographic films on mobile applications was granted bail on 20th September 2021. In his plea, he had submitted that he was being made a “scapegoat” without a solid and conclusive evidence. He also pleaded that he should be granted bail as the probe against him was complete. Kundra had also filed a fresh plea during the third week of September after the Mumbai Police’s chargesheet had named him as an accused.
Kundra’s plea also submitted that the other accused arrested in connection of the case was granted bail and hence his plea for bail should be considered as well stating parity as a ground for the same. It was also submitted that the police were unable show any evidence proving his connection with the mobile apps in question – Hotshots and Bollyfame where the adult films were published. He also added that he was not named in the FIR and the police dragged his name in the case. It was further stated that there was no involvement from his part in making any “questionable content” and he sought bail on the grounds of ongoing pandemic.
On the other hand, the police submitted that granting bail to Kundra might allow him to tamper with the evidence and influencing witnesses. However, the 46-year-old businessman was granted bail on 20th September on a surety of ₹50,000/- under certain conditions. Kundra was released from the Arthur Road jail on Tuesday, 21st September, 2021 shortly after 11.30 am.
