17th December 2021: Delhi high court terminated the petition stimulating a single judge order sitting for the decision of induction of 40 pilots. A bench of consisting of justice Rajiv Shakdhar and Talwant Singh espoused relief to pilot by single Judge ordering that the employer whose employment is fortified will be entitled to back wages not the re-instatement. The court also observed that after the judgement several pilots loomed to court with an application stating that they were not seeking re-in statements. They sought for paying back of wages until they get the alternative job because it’s hard to meet their expenses without the job. The Air India also appeal against the single-judge bench order to quash the decision passed against them on august 13, 2020 regarding the service termination of several pilots by stating that pilot sought resignation because they are getting better job offer from private sector and the unbearable financial crisis because of pandemic. The court found Air India objection as irrelevant. According to elementary back ground of the case, the pilot tendered their resignation but subsequently they sought for the withdrawal and the Air India firstly accepted the resignation and later on, allotted the termination of their service.
